On the night of Tuesday, October 8, a family of 4 was driving south down Blue Mound Road in Fort Worth, Texas. When a driver heading north tried to pass the car in front of him, he entered their lane and caused a fatal head-on collision.
The driver responsible for the crash was pronounced dead on the scene, as were the parents of two young sisters. The 10 and 13-year-old girls were rushed to Cook Children’s Hospital in critical condition. As they recover, the girls will be cared for by their aunt, who is a single mother and cannot afford their high medical bills.
In an outpouring of support, the Fort Worth community has raised over $3,700 via a GoFundMe campaign. While this is a wonderful demonstration of generosity, the girls could pay for their ongoing treatment and be compensated for their devastating loss in another way.
Filing a Wrongful Death Lawsuit
Because both their parents were killed in a collision caused by someone else’s negligent and unsafe behavior, the sisters who were injured in the accident should be able to file a wrongful death lawsuit against the other driver’s insurance policy. While minors cannot file lawsuits alone, the aunt who is now caring for them is a blood-relative of the deceased and can therefore file a claim on the family’s behalf.
If the family chooses to pursue a case, they can win damages to cover:
